Warranty
 Ventech Limited (“”) warrants that each product ("the Product”) will be free from defects in material and workmanship for a period corresponding to the lifetime of the original drainage system in which it is installed; failing which shall, at ’s sole discretion, supply a replacement for the defective Product free of charge or refund its price, and having done so, shall have no further liability in respect thereof.
- The above warranty is given by subject to the condition that shall be under no liability in respect of any defect arising from:
2.1. fair wear and tear;
2.2. failure to install the Product in accordance with ’s recommended installation instructions;
2.3. alteration to or repair of the Product without ’s approval;
2.4. abuse, misuse, defacement or wilful damage of or to the Product; or
2.5. negligence or abnormal working conditions affecting the Product.
- Subject as expressly provided herein, all warranties, conditions or other terms implied by statute or common law are excluded to the fullest extent permitted by law.
- Except in respect of death or personal injury caused by ’s negligence, shall not be liable by reason of any representation (unless fraudulent), or any implied warranty, condition or other term, or any duty at common law, or under the express terms of any agreement, or pursuant to any course of dealing, for loss of profit or for any indirect, special, consequential, incidental or contingent loss or damage, costs, expenses or other claims for compensation whatsoever (whether caused by the negligence of , its employees or agents or otherwise) which arise out of or in connection with the supply of the Product or its use or resale, and the entire liability of under or in connection with the supply of the Product shall not exceed the price of the Product, except as expressly provided herein.
